Terms of service

1) Scope

1.1 These Terms and Conditions (“Terms”) of Omar Ibrahim, trading as “Ibrano” (“Seller”), apply to all contracts concluded between the Seller and the customer (“Customer”) for the purchase of goods offered in our online store.
1.2 A “Consumer” means any natural person who is acting for purposes that are outside their trade, business or profession.
1.3 A “Business Customer” means a person or entity who is acting for purposes relating to their trade, business or profession.

2) Contract Conclusion

2.1 Product descriptions in the online store do not constitute binding offers but an invitation to place an order.
2.2 By completing the checkout process, the Customer submits a legally binding offer to purchase the selected goods.
2.3 The Seller may accept the Customer’s offer by:

  • sending an order confirmation by email;

  • shipping the goods; or

  • requesting payment after the order has been placed.
2.4 When payment is made via PayPal or Shopify Payments, the contract is concluded once the payment is confirmed.
2.5 The contract text is stored by the Seller and sent to the Customer by email after order submission.

3) Right of Withdrawal / Returns

3.1 In addition to rights under Australian Consumer Law (ACL), we offer a 30-day return policy.
3.2 Details are provided in our Refund & Returns Policy.

4) Prices and Payment Terms

4.1 Prices displayed in the online store are final and in Australian Dollars (AUD). Shipping costs, if applicable, will be shown separately during checkout.
4.2 Available payment methods are displayed in the online store (e.g. PayPal, Shopify Payments, credit card).
4.3 Payment processing may be handled by third-party providers (e.g. PayPal, Stripe).

5) Delivery and Shipping

5.1 Goods will be delivered to the shipping address provided during checkout.
5.2 If delivery fails due to reasons attributable to the Customer (e.g. incorrect address, failure to accept delivery), the Customer may be liable for additional costs.
5.3 Risk of accidental loss passes to the Customer upon delivery. For business customers, risk passes once goods are handed to the carrier.
5.4 Self-collection is not available.

6) Retention of Title

Goods remain the property of the Seller until full payment has been received.

7) Warranty (ACL Consumer Guarantees)

7.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Customers are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
7.2 This warranty applies in addition to any voluntary return policies offered by the Seller.

8) Liability

8.1 The Seller is liable for damage caused by gross negligence, intentional misconduct, or mandatory legal liability (e.g. under the Australian Consumer Law or product liability laws).
8.2 For minor negligence, the Seller’s liability is limited to foreseeable and typical damages.
8.3 Nothing in these Terms limits liability for death, personal injury, or mandatory statutory rights.

9) Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.

10) Dispute Resolution

The Seller is not obliged to participate in alternative dispute resolution through a consumer arbitration body. Customers may, however, have rights to escalate disputes under Australian Consumer Law.
